Terms of Service

1. Scope

These Terms of Service apply to the use of the FrameTrain service (website and desktop application), operated by Karol Paschek, Mainz, Germany. By using the service, you accept these Terms.

2. Description of Services

FrameTrain is a desktop application for local machine learning training. The service includes:

• Subscription access: €4.99/month or €39.99/year (Early Access price, increasing to €9.99 after the first 100 users)
• Access to the desktop app (Windows, macOS, Linux) for the duration of the active subscription
• Free updates throughout the subscription term
• Access to the online documentation
• Email support

3. Conclusion of Contract, Payment & Term

A contract is formed when you register and provide a payment method for the chosen subscription (monthly or yearly). Payment is processed by Stripe and charged automatically at the start of each billing period. After successful payment, you receive an API key that serves as your license key for the duration of the active subscription.

The subscription automatically renews for the respective billing period (month or year) unless cancelled before the end of the current period.

4. Cancellation

The subscription can be cancelled at any time, effective at the end of the current billing period, without giving reasons. Cancellation can be done via the dashboard or by email to framesphere@gmx.net. Once the cancellation takes effect, access to the desktop app ends at the end of the already-paid billing period.

5. Right of Withdrawal

As this involves digital content that is provided immediately after the conclusion of the contract, the right of withdrawal expires under § 356 (5) of the German Civil Code (BGB) once performance of the contract has begun, provided you have expressly agreed that performance begins before the withdrawal period ends.

6. License to Use

Upon purchase, you receive a non-exclusive, non-transferable license to use the FrameTrain desktop application for private and commercial purposes on your own devices.

The following is expressly prohibited:

• Sharing, selling, or sublicensing your API key
• Reverse engineering or decompiling the app
• Using the API for automated abuse

7. Availability

We strive for high availability of the service but cannot guarantee 100% uptime. The desktop app works fully locally – an internet outage does not affect training. Only license validation at startup requires an internet connection.

8. Limitation of Liability

The operator is not liable for indirect damages, lost profits, or data loss arising from the use of FrameTrain. Liability is limited to the sum of subscription fees paid in the last 12 months, to the extent permitted by law.

9. Changes to these Terms

We reserve the right to change these Terms. Material changes will be communicated to you by email. Continued use of the service after amended Terms take effect constitutes acceptance.

10. Governing Law

German law applies, excluding the UN Convention on the International Sale of Goods (CISG). The place of jurisdiction is Mainz, to the extent permitted by law.
